LICENCE AND BUSINESS TERMS AND CONDITIONS

Article 1 – Provider and General Provisions

1.1

These Licence and Business Terms and Conditions (hereinafter the “Terms and Conditions”) of the Center for the Study of Political Islam, z.s. (hereinafter the “Provider”), with its registered office at Lidická 700/19, 602 00 Brno, Czech Republic, Id. No. 03570894, registered with the Regional Court in Brno under the relevant register file, e-mail address: info@cspii.org, regulate the mutual rights and obligations arising between the Provider and another party to a contractual relationship (hereinafter the “User”) in connection with services provided by the Provider through the web portal at www.cspii.org (hereinafter the “Portal”).

1.2

The User may be a natural person or a legal entity.

Where the User is a consumer within the meaning of applicable Czech law (hereinafter the “Consumer”), provisions of applicable consumer protection legislation shall apply in addition to these Terms and Conditions.

A person who does not have full legal capacity may enter into transactions through the Portal only to the extent permitted by applicable law, including, where required, with the consent or assistance of his or her legal representative.

1.3

Legal relationships between the Provider and the User not expressly regulated by these Terms and Conditions shall be governed in particular by Act No. 89/2012 Coll., the Civil Code, as amended, Act No. 634/1992 Coll., on Consumer Protection, as amended, Act No. 121/2000 Coll., the Copyright Act, as amended, and other applicable laws and regulations of the Czech Republic and the European Union.

The processing of personal data is governed in particular by Regulation (EU) 2016/679 of the European Parliament and of the Council (the “GDPR”), Act No. 110/2019 Coll., on Personal Data Processing, as amended, and other applicable data protection legislation.

1.4

The Provider may amend these Terms and Conditions to a reasonable extent, particularly as a result of changes in legislation, changes to the Portal, changes to the services offered, technological developments or changes to the Provider's business processes.

The version of the Terms and Conditions applicable to an individual purchase shall be the version in force at the time the relevant contract is concluded. A subsequent amendment shall not adversely alter rights and obligations arising from a contract already concluded unless permitted by applicable law or agreed with the User.

Article 2 – Definitions

2.1

For the purposes of these Terms and Conditions, the “Service” means making an e-book available to the User by the Provider, normally in return for payment, together with granting the User a licence to use the e-book in the manner and within the scope specified in these Terms and Conditions.

2.2

For the purposes of these Terms and Conditions, an “e-book” means a copyrighted work made available in electronic form, including, where offered, formats such as MOBI, PDF or EPUB.

The Provider does not guarantee that every e-book will be available in every format. Unless stated otherwise, an e-book may also contain photographs, graphics, illustrations, audiovisual elements or other digital content.

For purposes of consumer law, an e-book supplied electronically may constitute digital content within the meaning of applicable legislation.

2.3

For the purposes of these Terms and Conditions, “Downloading” means the making available and acquisition by the User of an electronic copy of the relevant e-book or other digital content by electronic means.

Unless the Provider expressly states otherwise, access to a paid e-book is provided after successful payment of the applicable purchase price.

Article 3 – Ordering E-Books, Conclusion of Contract and Rights Arising from Defective Performance

3.1

To place an order, the User shall provide the information required by the relevant order form, including a valid e-mail address.

The User is responsible for ensuring that the information provided in the order is correct and complete.

The Provider may process the information supplied in connection with the order to the extent necessary to conclude and perform the contract, comply with legal obligations, protect its legitimate interests or for other lawful purposes described in the Provider's privacy information.

Where disclosed to the User before purchase and permitted by applicable law, identifying information associated with the relevant transaction may be incorporated into or otherwise technically associated with the supplied e-book for the purpose of protecting the Provider's or copyright holder's legitimate rights.

3.2

The User selects the relevant e-book or Service through the Portal and proceeds through the ordering process.

Before submitting an order, the User shall have an opportunity to review the order and correct entered information.

By submitting an order in a manner clearly indicating an obligation to pay, the User makes a binding order for the selected e-book or Service.

The contract is concluded when the Provider accepts the order in accordance with the ordering process displayed on the Portal. The Provider shall provide the User with appropriate confirmation of the concluded contract in electronic form.

Following successful payment, the Provider shall make the ordered e-book available for download or otherwise provide access to it and may also send a download link or other access instructions to the e-mail address provided by the User.

3.3 – Consumer Right of Withdrawal and Digital Content

A Consumer generally has a statutory right to withdraw from a distance contract within the period prescribed by applicable law.

In the case of paid digital content that is not supplied on a tangible medium, the Consumer's statutory right of withdrawal may cease once performance has begun, provided that all conditions required by applicable law have been satisfied, in particular where:

a) the Consumer has expressly consented in advance to performance beginning before expiry of the statutory withdrawal period;

b) the Consumer has acknowledged that by giving such consent he or she loses the right to withdraw from the contract once performance begins; and

c) the Provider has provided the Consumer with the confirmation required by applicable law.

Accordingly, where the Consumer expressly requests immediate provision of the e-book and gives the legally required consent and acknowledgement during the ordering process, the Consumer shall not have a right to withdraw from the contract once performance has begun, to the extent provided by applicable law.

Nothing in this Article limits any mandatory statutory rights of the Consumer relating to defective or non-conforming digital content.

3.4 – Conformity and Defects

The Provider shall supply the e-book or other digital content in conformity with the contract and with the requirements imposed by applicable law.

In particular, the supplied digital content shall, subject to the nature of the content and the terms of the contract, correspond to its description, quantity, quality, functionality, compatibility, interoperability and other agreed characteristics and be fit for the agreed or reasonably expected purpose to the extent required by law.

If the e-book or other digital content is not supplied or is defective or otherwise does not conform to the contract, a Consumer may exercise the rights and remedies provided by applicable law.

Depending on the circumstances and applicable statutory requirements, such remedies may include bringing the digital content into conformity, an appropriate reduction of the price or termination of the contract.

Nothing in these Terms and Conditions limits rights that cannot lawfully be excluded or restricted.

3.5 – Complaints

A User may submit a complaint concerning an e-book or Service by contacting the Provider at:

Center for the Study of Political Islam, z.s.
Lidická 700/19
602 00 Brno
Czech Republic

E-mail: info@cspii.org

The complaint should contain sufficient information to identify the relevant transaction and the alleged defect, preferably including the order number, identification of the purchased e-book and a description of the problem.

The Provider shall confirm receipt of a Consumer's complaint where required by applicable law and shall handle the complaint within the period and in the manner required by applicable legislation.

The Provider shall provide the Consumer with confirmation of the manner and date of resolution of the complaint, or, where applicable, written reasons for rejecting the complaint.

3.6 – Alternative Dispute Resolution

If a consumer dispute arises between the Provider and a Consumer under a purchase contract or a contract for the provision of services and the parties fail to resolve the dispute directly, the Consumer may be entitled to submit a proposal for out-of-court resolution of the dispute to the competent alternative dispute resolution entity.

For consumer disputes falling within its competence, the relevant entity is:

Czech Trade Inspection Authority
Central Inspectorate – ADR Department
Štěpánská 796/44
110 00 Prague 1
Czech Republic
www.coi.cz

The Consumer's right to seek protection before a competent court is not affected by the availability of alternative dispute resolution.

Article 4 – Provision of Services and Price

4.1

The price of each e-book or Service shall be displayed on the Portal before the User submits the order.

Unless expressly stated otherwise, prices displayed to Consumers include value added tax and all other taxes and charges that the Provider is required to include in the displayed price under applicable law.

Any additional charges payable by the User shall be disclosed before the order is submitted.

4.2

Unless stated otherwise during the ordering process, paid digital content shall be provided after successful payment of the applicable price.

The Provider shall make the e-book or other digital content available without undue delay after payment or at such other time as may have been expressly agreed with the User.

4.3

The User shall check the information entered during the ordering process before submitting the order.

The Provider shall not be responsible for consequences caused solely by incorrect information supplied by the User, except where such exclusion or limitation of liability would be contrary to mandatory applicable law.

Article 5 – Licence and Use of E-Books

5.1

Unless otherwise expressly agreed, upon lawful acquisition of an e-book the Provider grants the User a non-exclusive, non-transferable licence to use the e-book for the User's personal, non-commercial purposes and for an indefinite period, subject to these Terms and Conditions and the scope of the Provider's rights to the relevant work.

The User may download and store copies reasonably necessary for permitted personal use and backup purposes, subject to applicable law.

The use of a particular e-book may be technically restricted by digital rights management or other technological measures designed to protect copyright or enforce applicable licence conditions, provided such measures comply with applicable law.

The precise permitted scope of use may differ between individual e-books depending on the rights granted to the Provider by the relevant copyright holder.

5.2

Except to the extent permitted by applicable law or expressly authorised by the relevant rights holder, the User may not reproduce, distribute, communicate to the public, sell, rent, sublicense or otherwise commercially exploit the e-book.

The User may not modify, adapt, translate or otherwise alter the e-book except where such activity is permitted by applicable law or has been expressly authorised by the relevant rights holder.

Nothing in these Terms and Conditions shall restrict any statutory exception or limitation to copyright that cannot lawfully be excluded by contract.

5.3

The User shall not make an e-book available to third parties through file-sharing services, publicly accessible repositories, peer-to-peer networks or other means of unauthorised distribution.

5.4

The User shall not circumvent effective technological measures used to protect copyrighted content where such circumvention is prohibited by Section 43 of Act No. 121/2000 Coll., the Copyright Act, as amended, or by other applicable law.

5.5

Purchase of an e-book does not transfer ownership of copyright, trademarks, logos, trade names or other intellectual property rights to the User.

Except for the licence expressly granted under these Terms and Conditions, all such rights remain with their respective owners.

Article 6 – Payment Terms

6.1

The available methods of payment shall be indicated on the Portal during the ordering process. Where offered, payment may be carried out through PayPal or another payment service provider.

The use of a third-party payment service may additionally be subject to that provider's own contractual and privacy terms.

6.2

If the User believes that an incorrect amount has been charged, the User should notify the Provider without undue delay at info@cspii.org and provide information sufficient to identify the relevant transaction.

This provision does not limit any statutory rights of the User or any rights available under the rules of the relevant payment service provider.

Article 7 – Liability

7.1

The Provider shall not be liable for temporary unavailability or malfunction of the Portal caused by circumstances outside the Provider's reasonable control, including failures or interference by third parties, provided that this provision shall not exclude or restrict liability where such exclusion or restriction is prohibited by applicable law.

7.2

The Provider is not responsible for the functionality of the User's internet connection, hardware, operating system, software or other equipment that is not supplied or controlled by the Provider.

7.3

The User is responsible for ensuring that he or she has equipment and software capable of opening the file format selected or supplied, provided that the Provider has supplied the information regarding relevant technical requirements, compatibility and interoperability required by applicable law before conclusion of the contract.

This provision does not affect the User's statutory rights where the digital content itself does not conform to the contract.

7.4

The User shall be responsible for breaches of these Terms and Conditions in accordance with applicable law.

7.5

The User shall be responsible, in accordance with applicable law, for unauthorised use of copyrighted works constituting an infringement under Act No. 121/2000 Coll., the Copyright Act, as amended.

7.6

Nothing in these Terms and Conditions excludes or limits liability for damage or other harm to the extent that such liability cannot lawfully be excluded or limited, particularly mandatory rights available to Consumers.

Article 8 – Personal Data Protection and Commercial Communications

8.1

The Provider processes personal data relating to Users in connection with operation of the Portal, ordering and provision of e-books and Services, payment administration, customer support, protection of rights and compliance with legal obligations.

Depending on the relevant transaction, such personal data may include the User's name or other identification information, e-mail address, order and transaction information, payment-related information received from the payment service provider, technical information and communications with the Provider.

The Provider shall not process payment information that it does not receive from or need in connection with the relevant payment service.

8.2

The Provider processes personal data only where it has a lawful basis for doing so.

Depending on the purpose, the legal basis may include:

a) performance of a contract with the User or steps taken at the User's request prior to entering into a contract;

b) compliance with a legal obligation applicable to the Provider;

c) the Provider's or a third party's legitimate interests, where those interests are not overridden by the User's rights and freedoms; or

d) the User's consent where applicable law requires or permits reliance on consent.

8.3

Personal data shall be retained only for as long as necessary for the purpose for which it was collected or processed, including for the period required to comply with legal, accounting, tax, contractual or other obligations and to establish, exercise or defend legal claims.

8.4

The Provider shall process personal data in accordance with the GDPR, Act No. 110/2019 Coll., on Personal Data Processing, as amended, and other applicable data protection legislation.

Further information concerning the purposes and legal bases of processing, categories of personal data, recipients, retention periods, international transfers where applicable, the User's rights and contact information shall be provided in the Provider's privacy notice or other privacy information made available on the Portal.

8.5

The Provider shall implement appropriate technical and organisational measures designed to ensure a level of security appropriate to the risk associated with processing personal data.

Where a personal data breach occurs, the Provider shall comply with the notification and communication obligations arising under applicable data protection legislation, including notification to the competent supervisory authority and, where required, communication to affected data subjects.

8.6

Persons acting under the authority of the Provider who have access to personal data shall process such data only in accordance with the Provider's instructions, except where otherwise required by applicable law, and shall be subject to appropriate confidentiality obligations.

8.7

Subject to the conditions laid down by applicable data protection law, a User may have the right to request access to his or her personal data, rectification or erasure of personal data, restriction of processing, data portability, and to object to certain processing.

Where processing is based on consent, the User may withdraw that consent at any time, without affecting the lawfulness of processing carried out before its withdrawal.

A User may also lodge a complaint with the competent data protection supervisory authority, in particular the Office for Personal Data Protection of the Czech Republic.

Requests relating to personal data may be sent to the Provider at info@cspii.org or to another privacy contact specified in the Provider's current privacy notice.

8.8

The Provider may send commercial communications by electronic means only in accordance with applicable legislation, including applicable rules governing electronic commercial communications and direct marketing.

Where consent is legally required, such communications shall be sent only on the basis of valid consent.

Where applicable law permits commercial communications concerning the Provider's own similar products or services to existing customers without separate prior consent, the Provider may send such communications subject to the conditions prescribed by law.

The recipient shall in all cases be provided with a clear and simple means of refusing or unsubscribing from further commercial communications free of charge, except for ordinary costs of transmitting the refusal.

Article 9 – Final Provisions

9.1

Legal relationships between the Provider and the User shall be governed by the laws of the Czech Republic.

Where the User is a Consumer habitually resident in another country and mandatory consumer protection provisions of another applicable legal system grant the Consumer protection that cannot be excluded by agreement, this choice of Czech law shall not deprive the Consumer of such mandatory protection.

Nothing in these Terms and Conditions limits any mandatory rules concerning jurisdiction or the Consumer's right to bring proceedings before a court having jurisdiction under applicable Czech or European Union law.

9.2

If any provision of these Terms and Conditions is or becomes invalid, ineffective or unenforceable, this shall not affect the validity, effectiveness or enforceability of the remaining provisions.

Where appropriate and legally permissible, the invalid, ineffective or unenforceable provision shall be replaced or interpreted in a manner that most closely reflects its lawful commercial purpose.

9.3

These Terms and Conditions enter into force and effect on 13th October 2026.
